Despite Judge’s Orders, Bloomberg Forges Ahead on Large Soda Ban

Representatives from Mayor Michael Bloomberg’s administration were back in court on Tuesday, arguing in favor of a law he passed that would limit the sale of sugary drinks, three months after a state judge blocked it, reported The New York Times.

The fact that no ruling was reached pits the administration against a tight clock to get the block lifted, considering none of the mayoral candidates have a strong feeling about the ban one way or the other.

This means that in six months, when the administration changes, the case likely will get dropped.

Meanwhile, back in court, the city’s lawyer was hit with a barrage of skeptical (read: cynical) questions from four justices of the First Department of the Appellate Division, such as why milkshakes should be exempted from the rules and not sweetened iced teas.

One justice asked if the city might limit scoops of ice cream, while a lawyer raised the issue of steak size at Peter Luger.

Still, Bloomberg said he believes the city will get the soda ban passed, pointing to his recent victory in court with the taxi industry over a new class of livery cabs that can now pick up street hails outside of Manhattan.
